PACQUIAO CAN'T AVOID GIVING DEPOSITION

Filipino ring idol Manny Pacquiao cannot avoid giving his deposition in connection with the case filed by Golden Boy Promotions against Top Rank promoter Bob Arum for "tortuous interference" in the contract Pacquiao signed with Golden Boy in mid-September last year.

Golden Boy filed the suit after Pacquiao signed a second contract with Top Rank some two months later and received $1 million which was twice as much as that given him by Oscar De La Hoya’s Golden Boy Promotions.

Pacquiao had earlier told members of the original Team Pacquiao at a dinner prior to his departure with his family for the US that he had been informed by his lawyers that he can refuse to give his deposition because of an upcoming fight which is what he did the last time when he was in Los Angeles preparing for the bout against Jorge Solis.

However, Golden Boy Promotions CEO Richard Schaefer informed Viva Sports/Manila Standard Today that "this is a court ordered deposition which Manny has to take." He said they took De La Hoya’s deposition last week and it "would be funny if Oscar is required to do his and Manny is not." Besides, there has been no announced Pacquiao fight at this time and he is also not in training.

A deposition has been described as "one of the many tools lawyers use to gather information before a trial. If you are called or subpoenaed for a deposition you are being called to testify about your personal knowledge of facts that relate to a lawsuit." Under the rules in the case Pacquiao would be under obligation to answer questions truthfully and to the best of his knowledge under oath.

Schaefer also disclosed that he expects to meet with Marco Antonio Barrera shortly to find out what he wishes to do following persistent reports that the legendary Mexican wants a rematch with Pacquiao to avenge his November 2003 eleventh round TKO in San Antonio, Texas.

Pacquiao’s trainer Freddie Roach told Brad Cooney of Boxing Talk that he feels Barrera "deserves the rematch and he feels it too as he keeps talking about how he wants to avenge his defeat." Roach said "that’s the biggest money fight at this point" but he didn’t know if it could happen because of the legal battle between Golden Boy and Top Rank over promotional rights to Pacquiao.
